Terms and Conditions

These terms and conditions govern all supply of goods and services ("products") by CG Signage Christchurch to you, the purchaser of goods and services from us, including your use of the website at www.cgsignage.co.nz.

They are effective from 31 December 2024 and will replace all earlier CG Signage terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

Purchases

To make a purchase from our online shop, you must:

• Be 18 years of age or over.

• Be acquiring goods or services for your own use or consumption. Goods purchased via the website may not be acquired for resupply (whether in trade or otherwise).

• If purchasing on behalf of another entity such as a company, you warrant that you have the authorization to agree to these terms and conditions on behalf of the entity.

Availability and Supply

All orders are subject to product or service availability. If a product is unavailable, we will endeavour to notify you of the non-availability on our online shop.

If an item is out of stock, you may choose to place a backorder. We will notify you of the estimated delivery time for such orders.

Delivery and Delivery Charges

• Prices for goods and services stated on our website are exclusive of any applicable delivery charges.

• We only deliver to New Zealand street addresses. Deliveries to PO Boxes are not supported.

• The cost of delivery is as stated on our website, and a total delivery cost will be provided in the order summary.

• We will use all reasonable endeavors to ensure that orders for tangible goods are dispatched promptly after an order has been placed. Delivery times may vary depending on location, typically taking 3–6 business days.

• Orders are processed Monday through Friday, excluding public holidays.

• Customers may receive tracking details for orders once dispatched.

• We are not responsible for delays caused by the courier but will assist in resolving issues with lost or damaged goods.

Pricing

• All prices are in New Zealand Dollars and include Goods and Services Tax ("GST") unless stated otherwise but exclude delivery charges.

• Prices are correct at the time of publication and are subject to change without notice. However, orders already placed will not be affected by price adjustments.

• An invoice will be emailed to the email address you supply when you place your order. You are responsible for ensuring your contact details are correct.

Payment Options

We accept the following payment methods:

• Visa, MasterCard, and American Express

Payments are securely processed via Windcave and are subject to Windcave's terms and conditions, which can be found here: https://www.windcave.com/terms-and-conditions.

Credit Card Security

All payments are processed via Windcave, and we take reasonable measures to protect your payment information. However, we cannot be held responsible for breaches caused by third-party payment processors.

Shipping and Delivery

• Shipping costs are calculated once the customer has entered their delivery details.

• Delivery times typically range from 03–06 business days, depending on the location.

• Orders are shipped Monday through Friday, excluding public holidays.

• Tracking information will be provided once your order has been dispatched.

Returns and Refunds Policy

We do not have to provide a refund if you have changed your mind about a particular purchase, so please choose carefully. If the goods are faulty, we will meet our obligations under the Consumer Guarantees Act 1993 to provide a remedy.

If you receive the wrong item or damaged goods, you may exchange it, subject to stock availability. Claims for faulty goods must be made within 6 days of receipt.

Refunds will be processed within 6 days after approval of the return.

Cancellation Policy

Orders may be canceled within 2 hours of placement, provided they have not yet been processed. Once processed, cancellations are no longer possible.

Liability Limitation

Where you acquire or hold yourself out as acquiring goods or services from us for business purposes, the provisions of the Consumer Guarantees Act 1993 will not apply.

To the greatest extent permissible by law:

• We assume no responsibility for the completeness and accuracy of the information provided on our website.

• We exclude all liability for claims except where we have acted in bad faith.

• Our maximum liability to you shall be limited to the value of any faulty products or services supplied by us.

Force Majeure

We will not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, acts of God, government actions, or supplier delays.

Privacy Policy and Confidentiality

We take your privacy seriously. We may use personal information collected to provide products and services to you, administer orders, and process payments.

• We will not contact you unless you opt to receive messages from us. You can unsubscribe at any time.

• You agree to allow cookies for features of our website. If you choose not to enable cookies, some functionality may be unavailable.

• You can request details of your personal information that we hold and ask us to correct it at any time.

Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of CG Signage or its licensors. You may not copy, reproduce, or distribute any content without our prior written consent.

Governing Law and Jurisdiction

Use of our website, the supply of products or services, and any disputes arising under these terms are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction.

Dispute Resolution

Any disputes arising under these terms will first be attempted to resolve via mediation. If mediation fails, disputes will be resolved in the New Zealand courts.

General Conditions

If any provision of these terms is found invalid, the remaining provisions will remain in effect. Failure to enforce any terms does not constitute a waiver of rights.
